Each year, an estimated 100 workers die in construction accidents in the U.S., according to the Occupational Safety and Health Administration (OSHA). While the numbers appear to be going down, every couple of weeks, our attorneys read about tragedies in the Volunteer State.
Sadly, on November 18, a Shelbyville construction worker was killed in an accident at the Windstone subdivision, when a forklift he was operating overturned and pinned him. According to Brentwoodhomepage.com, Greg Rigney, 45, an employee of Sequatchie Concrete, was killed in the incident.
Rigney was reportedly offloading a delivery to a construction site when the accident occurred. He was pronounced dead at the scene of the crash. An investigation into the incident is ongoing.
As this case shows, a common form of a construction accident is a caught-in or in-between incident, where objects crush, squeeze, pinch or compress workers. This can include machinery and vehicles.
CAN I FILE A WRONGFUL DEATH LAWSUIT FOLLOWING A CONSTRUCTION ACCIDENT?
Keep in mind, if your family member is killed in a construction accident, you have a right to hold the contractor or employer liable via a wrongful death lawsuit.
Through a wrongful death lawsuit, you can seek compensation for the recovery of both economic and non-economic damages, which can help pay for items like lost income, medical expenses and funeral costs.
Construction accidents can be devastating for family members of victims. While no amount of money can ever bring your loved one back, damages from a lawsuit can help you overcome some of the financial losses you have suffered.
